Possession of Less Than 20g of Cannabis/Marijuana is a first degree misdemeanor and is punishable by up to one year in jail in Florida. Certain enhancements can increase the penalty for Possession of Marijuana.
For example, Possession of More Than 20g or Possession With Intent to Sell/Manufacture/Deliver Marijuana enhances the penalty to a maximum of five years in prison and to a felony of the third degree. Other enhancements may also apply, such as “sale within 1000 feet of a school or church”.
Trafficking in Marijuana can be proved by the weight in possession or by the number of plants possessed. Depending on the amount, Trafficking in Marijuana will carry a mandatory minimum sentence of 3, 7, or 15 years in prison.
